Terms & Conditions of Sale

1. Seller identification

2. Scope

These Terms and Conditions govern the sale of products through exmo.pt to business customers (B2B) and end consumers, in Portugal, Spain and other destinations where ExMo offers shipping.

3. Products, prices and VAT

Prices shown on the site are in euros. Unless stated otherwise, prices shown on the product page are displayed excluding VAT; applicable VAT is added at checkout before order confirmation.

ExMo reserves the right to correct obvious pricing or description errors before an order is accepted.

4. Payment

Payment is processed via the easypay gateway. ExMo does not store payment card data.

5. Order acceptance

The sales contract is considered formed at the moment ExMo confirms payment for the order, not when the customer submits it.

6. Delivery

Delivery timeframes, carrier and shipping costs are detailed on our Shipping & Delivery Information page (https://exmo.pt/en/shipping).

7. Right of withdrawal (consumers)

If you are an end consumer (a private individual purchasing outside your professional activity) and you buy at a distance, you have the legal right of withdrawal set out in Decree-Law No. 24/2014 (transposing Directive 2011/83/EU), without needing to give a reason, within the period stated in our Returns & Refunds Policy.

This right generally does not apply to purchases made by businesses in the course of their professional activity.

8. Legal conformity guarantee

Products sold to consumers are covered by the legal conformity guarantee under Portuguese law (currently Decree-Law No. 84/2021), which generally sets a 3-year period for movable goods from delivery. We recommend confirming the exact applicable period with a legal professional, as it may vary by product and buyer type.

9. Limitation of liability

ExMo will not be liable for indirect damages arising from the use or inability to use the products, except where the law does not permit limiting liability.

10. Governing law and jurisdiction

These Terms are governed by Portuguese law. Any dispute will be submitted to: Comarca de Viseu, Portugal.

Consumers residing in Portugal may also use the electronic Complaints Book (Livro de Reclamações, www.livroreclamacoes.pt) or an alternative consumer dispute resolution entity.

11. Changes

ExMo may update these Terms at any time. The version applicable is the one published on the site at the time the order is placed.
